Thank you and Welcome to Big Plan

By accepting to the Term of Service located on bigplan.com.my, you become a party to this Service Agreement (the “User”); and

5 Big Person Sdn Bhd (Company No. 1368821-M) (“Big”), a company incorporated in Malaysia, having a registered address Unit 310, 3rd floor, Lobby 2, Block A Damansara Intan, No 1 Jalan SS20/27, 47400 Petaling Jaya, Selangor Malaysia (the “Service Provider”).

Please note that you must be at least 18 years of age before you are eligible to accept this Service Agreement as according to the Law of Malaysia.

Our Privacy policy, Security policy and Disclaimers shall form part of this Agreement and shall be read in aggregate to this Agreement. 

  1. The services we provide
    With the vision to create a world full of responsible adults through financial literacy, Big is formed to create a total integrated and interactive personal financial planning platform. Big is a licensed financial planner by the Securities Commission Malaysia under the Capital Markets and Services Act 2007.

    The web based platform (“Big Plan”) provides User with financial tools to know your numbers, be ahead of the curve and out of poverty through 3 simple steps of [1] Account, [2] Analyze and [3] Action.
  2. The service fee we charge 
    Big is based on
    subscription fee paid by registered User. There are 3 different packages User can gain access to Big Plan:

    1. Free access to Profile, Cash In and Protection module only
    2. Pro for RM15.00 per month or RM120.00 per year to access all Big Plan modules
    3. Class (onsite) for RM89.00 with 3 months access to all Big Plan modules

    *RM means Ringgit Malaysia

    Any overdue service fee shall be given an additional 14 calendar days together with an email notification failing which Big shall temporarily suspend your access till any outstanding is settled in full. Temporary suspended user account for a period of more than 90 calendar days from the due date shall be permanently deleted from our database. 
  3. Service and site maintenance
    Big works hard to provide the best service or platform it can be but acknowledges that complex software is never wholly free from defects, errors, bugs and security vulnerabilities. Big Plan, however, is provided "as is", and Big make no guarantees that Big Plan will always be safe, secure or error-free, or that Big Plan will function without disruptions, delays or imperfections.

    Transaction data entered by User shall be stored in the database and routinely backup for a period up to 2 years.

    Big shall use reasonable endeavors to maintain the availability of Big Plan to User between the public internet and the network of the hosting services provider but does not guarantee 100% availability. For the avoidance of doubt, downtime caused directly or indirectly by any of the following shall not be considered a breach of this Agreement:

    (a) a Force Majeure event which gives rise to a failure or delay in either party performing any obligation under this Agreement (other than any obligation to make a payment), that obligation will be suspended for the duration of the Force Majeure event;
    (b) a fault or failure of the internet or any public telecommunications network;
    (c) a fault or failure of the User's computer systems or networks;
    (d) scheduled maintenance carried out by Big with prior written notice given to User;
    (e) upgrade to Big Plan. 
  4. User support
    Big shall provide a User Support Helpdesk to User with prompt respond as and when possible. 
  5. Notices
    Any notice shall be sent by Big to User via email stored in Big Plan under the Setting, in which case the notice shall be deemed to be received upon the stated time and date of the mail server.

    User shall be responsible to keep the email address stored in Big Plan up to date. User can send any notice or feedback in regards to this Agreement or Big Plan to this email address support@bigplan.com.my.
  6. User’s warranties 
    As a registered User of Big Plan, you agree and warrant that:

    1. It is solely for your own personal use and must not be used to provide services to any third parties.

    2. You are responsible for maintaining the confidentiality of your login ID and password which allow you to access Big Plan.

    3. All required alert and notices to be sent electronically to your email address and it is your responsibility to update or change that address when appropriate.

    4. You must not copy, republish or redistribute any content or material from Big Plan. Any distribution, reprint or electronic reproduction of any content or material in whole or in part for any purpose is strictly prohibited.

    5. You shall not access or use Big Plan in any unlawful manner and for any unlawful purpose which violates the applicable laws, rules and regulations.

    6. You shall not use any written program, algorithm or methodology to access, acquire, copy or monitor Big Plan in attempt to decipher, decompile, disassemble, or reverseengineer any of the software comprising or in any way making up a part of Big Plan.

    7. You shall defend, indemnify and hold harmless Big Plan from and against any claims, damages, obligations, losses, liabilities, costs or debt, demands, and expenses arising from your use of and access to Big Plan.

    8. You shall pay any service fee due to be paid to Big under this Agreement promptly. 

    Please note that any attempt breach or violation of the warranties may result in Big temporary suspending your access to Big Plan.  
  7. Termination and refund policy  
    Either User or Big can terminate this Service Agreement through the platform under Setting.

    For User with Pro access, there shall not be any refund on the service fee paid either month or year. User with Pro and paid on a year basis is charged with a lower month service fee that comes together on a no refund on termination.

    As for User with Class (onsite), a seven (7) calendar days termination notice needs to be given prior to the onsite class scheduled date for a full refund with a RM5.00 administration fee deducted. 
  8. Modification to this Agreement  
    Big reserves the right to modify this Agreement as and when it deems necessary and user shall bound to agree to this revised Agreement as you continue to use Big Plan. Any modifications to this Agreement shall be posted on the bigplan.com.my site with the last revised date and supersedes any previous Agreement.
